Implementation Rules for Children of Migrant Workers in Zengcheng District, Guangzhou City to Receive Compulsory Education (Revised)

　　Article 1In order to further standardize the enrollment management of schools at the stage of compulsory education and effectively carry out the improvement of compulsory education for the children of migrant workers in Zengcheng District, Guangzhou City, so as to enhance the service efficiency of equal education public resources and promote satisfying urban construction of Zengcheng District, in accordance with the key points of the Compulsory Education Law of the People's Republic of China, and the General Office of the People's Government of Guangdong Province's Opinions on Improving the Compulsory Education for the Children of Migrant Workers in Cities (Y. F. B. [2011] No. 45), Notice of the People's Government of Guangzhou City on Printing and Issuing Regulations on Service Management of the Points System of Migrant Workers in Guangzhou City (S. F. G. [2021] No. 7), Notice of Guangzhou Service Administration for Migrant Workers in Guangzhou City on Printing and Issuing Implementation Rules on Service Management of the Points System of Migrant Workers in Guangzhou City (S. L. S. G. Zi [2021] No. 1), and Notice of Guangzhou Education Bureau and Guangzhou Service Administration for Migrant Workers in Guangzhou City on Improving the Compulsory Education for Children of Migrant Workers in Guangzhou City (S. J. G. Zi. [2023] No. 4), the Rules is hereby formulated combined with the actual situation of Zengcheng District.

　　Article 2In the Rules, the term "migrant workers" refers to residents who have no household registration registered in Guangzhou City yet have lived in Guangzhou City.

　　The Rules applies to the children of migrant workers who have reached the age of 6 before August 31 of the current year, have not yet entered school and planned to enter the first grade of primary school in the current year, or have graduated from primary school in the current year and planned to enter the first grade of junior high school, and applied to enroll in public schools of compulsory education or private schools subsidized by the government.

　　Article 3In order to help the children of migrant workers in Zengcheng District receive compulsory education, a leading group for the work of helping the children of migrant workers in Zengcheng District receive compulsory education is set up, which is responsible for the overall planning, coordination and organization of the implementation of various works. The group leaders include the leader in charge of education in Zengcheng District and the leader in charge of the service management of migrant workers. The Director General of Zengcheng District Education Bureau and the Director General of Zengcheng District Service Administration for Migrant Workers in Guangzhou City are the deputy group leaders. The relevant functional departments directly Zengcheng District, the people's government of all towns and the sub-district offices shall be the member units. Member units and their respective responsibilities are listed as follows:

　　Zengcheng District Service Administration for Migrant Workers in Guangzhou City shall be responsible for accepting the enrollment applications for the children of the migrant workers under the points system, calculating the points and publicizing the results; collecting and registering the applicants' residence in Zengcheng District, and providing statistical data about the applicants' residence in Zengcheng District; and also be responsible for reviewing the applicants' information and materials such as years of residence permit and the house rented in Zengcheng District.

　　Zengcheng District Education Bureau shall take the lead in formulating enrollment plans for schools with compulsory education stage within their jurisdiction areas and determining the private schools accessible to enrollment quota subsidies; integrally arranging the enrollment quota according to the score of the applicant based on the principle of open admission; being responsible for the overall planning and coordination of all town governments and sub-district offices, optimizing the education layout, fully tapping the potential of public primary and secondary schools, increasing support for private schools that mainly accept children of migrant workers in Guangzhou City according to the actual needs for enrollment of children of migrant workers in the jurisdiction areas, examining, approving and managing according to law and also standardizing their school-running behavior, so as to meet the requirements of children of migrant workers in Guangzhou City to receive compulsory education in Zengcheng District as far as possible.

　　Zengcheng District Development and Reform Bureau shall be responsible for incorporating the work of children of migrant workers receiving compulsory education in Zengcheng District into the economic and social development plans and annual plans, including the construction of relevant schools in the fixed assets investment plans and annual plans, reviewing the education fee standards implemented by the public (private) schools under its jurisdiction and standardizing school fees in accordance with the relevant national, provincial and municipal regulations.

　　Zengcheng District Government Service Data Administration shall be responsible for providing technical support for the district e-government network access to the relevant information system of public schools in the compulsory education stage for the children of migrant workers to ensure a safe and smooth network operation environment.

　　Zengcheng District Finance Bureau shall be responsible for providing financial guarantee for the children of migrant workers to receive compulsory education in accordance with the provisions of the Rules.

　　Zengcheng District Convergence Media Center shall be responsible for the publicity of the Rules and points enrollment.

　　The Human Resources and Social Security Bureau, the Administration for Market Regulation, the Health Bureau, the Public Security Bureau, the Planning and Natural Resources Bureau, the Civil Affairs Bureau, the Taxation Bureau, and the Youth League Committee of Zengcheng District, as well as the Development Zone Enterprise Service Bureau and other relevant departments shall, according to their respective functions, help the children of migrant workers receive compulsory education.

　　Article 4All town governments, sub-district offices and other relevant units shall, in accordance with the principle of territorial administration, set up corresponding leading groups for special work. According to the requirements of Guangdong Province, in accordance with the principle of government administration and full-time public schools in the destination area, the aforesaid leading groups shall be responsible for organizing the implementation of compulsory education for the children of migrant workers in the region, bringing the work into the education development plan of the region, and fully tapping the potential of enrollment quota of public schools in the region; actively cooperating with the district government and relevant functional departments to carry out the examination and management of relevant enrollment application materials, and effectively protecting the legitimate rights and interests of the children of migrant workers to receive compulsory education in Zengcheng District.

　　The Development Zone Enterprise Service Bureau shall work with Zengcheng District Education Bureau to formulate the work plan for the migrant children of management and technical talents and important employees of key enterprises in Guangzhou City to accept compulsory education. The Development Zone Enterprise Service Bureau, together with town governments and sub-district offices, shall organize the application of key enterprises within the jurisdiction, examine the list of migrant children of management and technical talents and important employees of key enterprises in Guangzhou City who apply for the starting grade of public schools of compulsory education in Zengcheng District, and publicize the list of migrant children of management and technical talents of key enterprises who apply for admission to the starting grade of public schools of compulsory education in Zengcheng District at the Development Zone Enterprise Service Bureau, town governments, sub-district offices and enterprises, and then submit the list to Zengcheng District Education Bureau and Zengcheng District Service Administration for Migrant Workers in Guangzhou City.

　　Article 5For those who meet the relevant provisions of Guangzhou Municipal Enrollment Policy and meet one of the following two requirements, if the children of such migrant workers apply to study in the first grade of primary school and the first grade of junior high school, Zengcheng District will choose the public schools at priority within the jurisdiction to arrange the enrollment quota.

　　(I) Children of migrant workers living in the district who meet the policy-based preferential treatment conditions of compulsory education in Guangzhou City shall be arranged to study in public schools according to the principle of "open admission in the neighborhood" after the application materials are verified by Zengcheng District Education Bureau or the local teaching guidance center in accordance with regulations.

　　(II) Migrant children of high-end talents who conform to the provincial, municipal and local high-end talents management rules, and the migrant children of management and technical talents and important employees of key enterprises in Zengcheng District, shall be arranged by Zengcheng District Education Bureau to study in public schools according to the principle of "open admission in the neighborhood".

　　Children of migrant workers who meet the requirements of Item (I) and migrant children of high-end talents at the provincial, municipal and district level who meet the requirements of Item (II) shall register at the town / sub-district teaching guidance center of the place of residence during the enrollment period of registered students of Zengcheng District and submit relevant certification materials; for migrant children of management and technical talents and important employees of key enterprises in Zengcheng District who meet the requirements of Item (II), the enterprise shall collect materials uniformly, and apply to the town governments, sub-district offices and Zengcheng Development Zone Enterprise Service Bureau of the place of domicile.

　　Article 6For those who do not conform to the provisions of Article 5 of the Rules yet hold the valid Residence Permit of Guangdong Province issued in Guangzhou City for more than 1 year (the "more than 1 year" shall be counted continuously, and the expiry date of calculating the years of residence permit is August 31 of the current year), they can apply for their school-age migrant children to enroll in the first grade of primary schools or first grade of junior high schools of public schools of the compulsory education stage in Zengcheng District or private schools in the jurisdiction subsidized by the government by calculating points, or they can also choose private schools at their discretion according to their actual situation and willingness to achieve children's enrollment.

　　Article 7Work Flow of Points System Admission:

　　(I) Application for points, inquiry & objection. If migrant workers apply for their children to attend public schools of compulsory education stage in Zengcheng District, Guangzhou City, they must first apply for points by registering and logging into the "Guangzhou Migrant Workers Points System Service Management Information System" to fill out the application materials, upload the pictures and confirm the submission in the system. After the online verification, applicants shall go to the point-based service management window of the town / sub-district integrated service center (Migrant Workers Center) where the residence permit application is made with the relevant materials (originals) for verification. See Annex 1 for details of the index system and score table of the points-based enrollment service management for migrant workers in Zengcheng District.

　　If the relevant points index of the applicant changes, points shall be adjusted accordingly. The information system will automatically adjust the age of the applicant and the points of the residence permit; if the applicant's legal and stable residence, legal and stable employment, educational level, technical ability, innovation and business startup, urgently needed jobs or vocational qualifications and service industries, social services and public welfare, tax payment, commendation awards and other indicators have changed, the applicant should take the initiative to apply for points adjustment in the “Guangzhou Migrant Workers Points System Service Management Information System”, and the process of adjustment materials shall follow the points procedure for initial application.

　　After the points application or adjustment is officially accepted, the applicant can check the progress and result of his/her points application at any time by logging in the Migrant Workers Points System Service Management Information System.

　　If the applicant has any objection to the points value, he/she shall apply to the original points system acceptance window for verification within 30 days from the date of announcement, and go through relevant procedures according to the procedures stipulated in the Notice of Service Administration for Migrant Workersin Guangzhou City on Printing and Issuing the Implementation Rules of the Service Management Regulations of Guangzhou Migrant Workers Points System.

　　(II) Application for admission by points. After obtaining the points, applicants can apply for admission by points through logging on the "Zengcheng District People's Government Portal Website" (/) and searching "Zengcheng District Points-based Admission System" to apply online.

　　(III) Examination and approval. After the admission applicant submits the application online, all relevant departments shall review the application materials submitted by the admission applicant within the prescribed time and issue the examination results of the corresponding points.

　　(IV) Admission points inquiry and objection. Applicants can check the points result on the "Zengcheng District Points-based Admission System". If applicants have any question or objection to the audit result and scoring of Zengcheng District additional score index project, applicants can log in the "Zengcheng District Points-based Admission System" within the specified time or take relevant materials to the corresponding functional departments for consultation and review. The points-based admission system will recalculate points based on the results of the review.

　　(V) Points ranking. The "Zengcheng District Points-based Admission System" will automatically generate the applicant's total points, which will be sorted from the highest to the lowest by town or sub-district. If the total points are the same, the duration of residence permit held by the applicants in Zengcheng District and the scores of social security projects will be compared in order to determine the ranking order of the total points of the applicants in the town or sub-district. Admission applicants' total points are displayed in the "Zengcheng District Points-based Admission System" and are available for the inspection of applicants.

　　(VI) Announcement of enrollment quota. On the premise of ensuring the completion of the enrollment tasks of students from the registered area in Zengcheng District and students conforming to the provisions of Article 5 of the Rules, Zengcheng District Education Bureau shall uniformly announce the remaining number of enrollment quota to the public through Guangzhou Zengcheng District People's Government Portal Website.

　　(VII) Filling out the application. Applicants shall apply online at "Zengcheng District Points-based Admission System". Applicants are required to apply for admission to the four preferential schools in the same town or sub-district based on the town or sub-district where they live.

　　(VIII) Admission. Zengcheng District Education Bureau delimits the qualification in each town or each sub-district's point-based admission according to the enrollment quota and applications. The application admission only applies to the applicants who meet the corresponding town or sub-district's point-based admission requirements. The application process is divided into two rounds. In the first round of application, all those eligible for application will be submitted to the relevant schools in the district (generated by the system according to the legal stable residence filled out by the applicants), and the schools will enroll them according to the points from the highest to the lowest. After the first round of application is completed, the second round of application will be conducted. The second round of admission is only for applicants who are not admitted to the schools in the district due to lack of enrollment quota or insufficient enrollment quota in the schools while meeting the shortlisted eligibility requirements of the corresponding town or sub-district. In the second round of application, applicants will be admitted according to their preference in order of points from the highest to the lowest (first to their most preferential school, and if they are not admitted, they will be admitted to the second preferential school).

　　(IX) Public announcement of admission results. After the application and admission, Zengcheng District Education Bureau will publish the admission results of all public schools in the towns and sub-districts on the district government's portal website for 7 days. Applicants can check the admission results through "Zengcheng District Points-based Admission System". If applicants have any objection to the admission results, they may raise their objection in writing to Zengcheng District Education Bureau within 5 days after admission results are announced. Zengcheng District Education Bureau shall, within 5 days from the date of receipt of the objection, conduct a review and reply to the applicant in writing.

　　(X) Registration. After the announcement period is over, the children of migrant workers who apply for admission to public schools by points must register at the schools within the specified time. Those who fail to register or obey the arrangement within the time limit will be treated as automatically giving up their enrollment quota and will not be admitted to the compulsory education public schools in Zengcheng District in any form. The admission points obtained by applicants who participate in the application for points this year will automatically become invalid.

　　Article 8For children of migrant workers in Guangzhou City who have not obtained the enrollment quota of public schools through the Rules, applicants may apply for enrollment for the children of migrant workers in the private schools established after examination and approval.

　　Article 9Children of migrant workers in Guangzhou City who apply for admission to public schools through points shall be entitled to the same treatment as local students during the school period. The receiving school shall establish school records for the enrolled children of migrant workers, and submit them to the examination and approval authorities for the record in accordance with regulations, so as to ensure that they are entitled to the same treatment as local students in terms of academic recognition, Young Pioneers membership, the Communist Youth League membership, excellence selection activities, selection of student cadres and participation in various activities. At the same time, schools should strengthen ties with students' families, pay attention to students' physical and mental health, and help students integrate into campus life as soon as possible.

　　Article 10Applicants who apply for admission to public schools for their migrant children must ensure that the application materials provided by them are authentic and valid. If any fraudulent behavior is found, the applicant's eligibility for application in the current year and the enrollment quota in the public school that has been successfully applied for are immediately cancelled.

　　Article 11Where administrative management departments and their staff violate the provisions of the Rules and fail to perform their duties in accordance with the law, the competent authority shall order them to rectify the situation, and the responsible leaders and directly responsible personnel shall be disciplined in accordance with the law; if their actions constitute a crime, criminal responsibility shall be pursued according to law.

　　Article 12The Rules shall come into force as of the date of promulgation and shall be valid for 3 years. The Notice of the People's Government Office of Zengcheng District, Guangzhou City on Printing and Issuing the Implementation Rules for Children of Migrant Workers in Zengcheng District, Guangzhou City to Receive Compulsory Education (Revised in 2022) (Z. F. B. G. [2022] No. 3) is hereby abolished.
